Additional privacy policy information relating to the use of the online payment system "ePayServiceBayern"

General information

The University of Munich (LMU) provides the online payment system "ePayServiceBayern" as part of the roll-out of e-government in public authorities in the state of Bavaria in accordance with the Bayerisches E-Government-Gesetz (Bavarian E-Government Act).

The office responsible for the "ePayServiceBayern" online payment system is the State Finance Office:

The online payment system enables the fully digital payment of fees, services and other charges incurred at the LMU. The following methods of payment are supported at present:

  • Card payment (e.g. MasterCard, VISA)
  • Direct debit (SEPA direct debit)
  • Electronic payment systems (PayPal)

To enable the LMU to connect to the State Finance Office's online payment system a linking element (interface) has been programmed that transfers certain data relevant to the payment process from the University's own system to the online payment system. In order to enable the payment to be processed, this interface will be used to transfer the required data to the Staatsoberkasse Bayern (Bavarian State Accounts Office) in Landshut.

This privacy policy notice relates primarily to data processing within the framework of the LMU interface to "ePayServiceBayern". The LMU is the data controller responsible for processing this data within the terms of Art. 4 no. 7 DSGVO. The Landesamt für Finanzen, or a payment service provider (e.g. PayPal) authorised by the Landesamt for this purpose, is responsible for enforcing the data protection regulations within the actual payment process via "ePayServiceBayern".

Privacy policy of the University Library of the LMU

The University Library of the LMU uses "ePayServiceBayern" to facilitate the payment of fees and other charges (e.g. interlibrary loan fees, reservation fees, fines) quickly and conveniently. If a user account has been suspended because of unpaid fees, this suspension can be reversed immediately and the active use of core library services restored at once. As an alternative to the online payment system the University Library's pay station can continue to be used for cash payments, although this may lead to longer processing times (§ 14 par. 1 clause 2 BBankG).

Categories of personal data

We process only the personal data that you have provided to us or that we have received, and are permitted to use, in an authorised manner (Art. 4 par. 2 BayDSG). The LMU stores the following personal data when you use the online payment system:

  • University Library user number (library number of the University Library of the LMU)
  • First and last name
  • E-mail address
  • Postal address

In connection with your University Library number (library number) the following additional information about you will be stored:

  • Type of amount (fines, fees)
  • Amount due (unpaid usage fees, total amount)
  • Time stamp at the start of the payment process
  • Invoice date
  • Date the payment is due

The LMU does not store any of your bank details in this way, nor does it have technical access to such information.

Legal basis

We process your personal data in accordance with, and on the basis of, the Datenschutz-Grundverordnung (DSGVO - the General Data Protection Regulation), the Bayerisches Datenschutzgesetz (BayDSG - the Bavarian Data Protection Act) and other applicable data protection regulations.
Provision of "ePayServiceBayern" is subject to Art. 4, 5, 18 BayDiG. Your personal data related to your use of the online payment system will be processed according to Art. 6 par. 1 lit. b DSGVO (contract fulfilment), in accordance with Art. 6 par. 1 lit. c together with § 11 No. 2 Benutzungsordnung für das Bibliothekssystem der Universitätsbibliothek München (Library regulations for the University Library of Munich system), in fulfilment of the LMU's legal obligations, and Art. 6 par. 1 lit. e, par 2, 3 DSGVO together with Art. 4 par. 1 BayDSG, Art. 2 BayHSchG, §§3, 12 Allgemeine Benützungsordnung der Bayerischen Staatlichen Bibliotheken (General regulations governing the use of the Bavarian State Libraries, ABOB), in fulfilment of a public obligation.

Data transfer during payment transactions

When you use "ePayServiceBayern" your personal data will be passed on to the Landesamt für Finanzen des Freistaates Bayern (Bavarian State Office of Finance). Data will be transferred only at the behest of the user during the payment transaction. The results of a transaction (e.g. notification that the amount has been paid) will be sent to the LMU; no details of the payment method used will be given.

To enable you to use the online payment system as intended, you must enter the required data in the payment system you have chosen for the transaction. The data will then be forwarded

  • in all cases to the Landesamt für Finanzen, which then transfers the data entered in the online form to its own bank, the Staatsoberkasse Bayern/Landshut,
  • to Telecash, the external service provider subcontracted by the Landesamt für Finanzen (when you pay online by credit card [or direct debit]).
  • to the external service provider PayPal (when you pay online using PayPal).
  • Please note that PayPal may also pass on personal data to service providers, subcontractors or other affiliated organisations. A list of third parties with whom PayPal may share personal data can be found at https://www.paypal.com/de/webapps/mpp/ua/third-parties-list?locale.x=en_DE. Depending on the payment method you select within PayPal (e.g. invoice or direct debit), PayPal will forward your personal data accordingly. Retention period for personal data

Your personal data will only be stored by the LMU until the contractual, legal or regulatory obligations have been discharged, or in fulfilment of statutory duties.

The online payment system "ePayServiceBayern" is configured in such a way that personal data stored there will be deleted after a two-year period. External payment service providers (e.g. PayPal) may set other time limits.

Statutory retention regulations, especially those pertaining to state budgetary and tax legislation, may stipulate the storage of payment data for up to 10 years.
